Court Rules Against Blocking eBay Sales

Berlin's highest state court has decided that manufacturer Sternjakob may not prohibit a Berlin online retailer from selling their products on marketplaces such as eBay and Amazon.

The retailer had fought the case for several years, having won a previous ruling at a lower court in 2009. Oliver Prothmann, founder and spokesperson for the Choice in eCommerce campaign, welcomed the verdict and said "This is an important milestone for the online-seller and the trade overall."

"The decision of the Supreme Court is an important step for more legal certainty. It shows that a flat ban on sales through Amazon, eBay and other marketplaces is not possible. A merchant can now keep that judgment against manufacturers. The decision shows once again that it pays to fight as a merchant and not simply accept such restrictions," continued Prothmann.

Sternjakob is the manufacturer of backpack brands Scout and 4You.
